1. Acceptance of Terms
By accessing or using the TikLynx platform ("Platform"), operated by SimmTech Software LLC ("TikLynx," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.
2. Platform Description
TikLynx is a multi-tenant event ticketing and management platform. We provide technology services that enable event organizers ("Organizations") to create, manage, and sell tickets to events, and enable individuals ("Buyers") to discover and purchase tickets.
TikLynx is a technology platform, not an event organizer. We do not organize, host, or control events listed on our Platform. Each event is independently organized and managed by the Organization that listed it.
3. Account Registration
To use certain features of the Platform, you may need to create an account. You agree to provide accurate information, maintain the security of your credentials, and notify us immediately of any unauthorized access. You are responsible for all activity under your account.
4. Ticket Purchases
When you purchase tickets through the Platform:
- You are entering into a transaction with the Organization hosting the event, not with TikLynx
- TikLynx facilitates the payment processing on behalf of the Organization
- All ticket sales are subject to the Organization's own terms, refund policies, and event rules
- Ticket availability and pricing are determined by the Organization
5. Payment Processing
Payments are processed securely through Stripe, Inc. By making a purchase, you also agree to Stripe's Terms of Service. TikLynx does not store your payment card information.
6. Refunds and Cancellations
Refund policies are set by each Organization individually. TikLynx facilitates refund processing on behalf of Organizations but does not independently determine refund eligibility. If you have a refund request, contact the Organization that hosted the event. If you are unable to reach the Organization, contact TikLynx support for assistance.
7. Organization Responsibilities
Organizations using the Platform are responsible for:
- The accuracy of event listings, descriptions, and pricing
- Fulfilling events as described
- Communicating changes or cancellations to ticket holders
- Complying with applicable laws and regulations
- Their own privacy practices and data handling once buyer information is received
8. Limitation of Liability
TikLynx provides the Platform "as is." To the maximum extent permitted by law:
- We are not liable for the actions, omissions, or conduct of any Organization or event attendee
- We are not responsible for event cancellations, changes, or quality
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform
- Our total liability shall not exceed the fees you paid to TikLynx (not the Organization) in the twelve months preceding the claim
9. Intellectual Property
The Platform, including its design, features, and content (excluding user-submitted content), is owned by SimmTech Software LLC. You may not copy, modify, distribute, or reverse engineer any part of the Platform without our written permission.
10. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Platform
- Interfere with the Platform's operation or security
- Resell tickets in violation of the Organization's policies or applicable law
- Submit false or misleading information
11. Termination
We may suspend or terminate your access to the Platform at any time for violation of these Terms or for any reason at our discretion. Upon termination, your right to use the Platform ceases immediately.
12. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Michigan.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last Updated" date. Continued use of the Platform after changes constitutes acceptance.
